These Terms govern your access to and use of the Altaveyr Technologies public marketing website.

These Terms of Service ("Terms") govern your access to and use of the Altaveyr Technologies website, including the content, features, forms, and services made available through the website (collectively, the "Website").
The Website is operated by Altaveyr Technologies LLC ("Altaveyr," "we," "us," or "our").
By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the Website.
1. Scope of These Terms
These Terms govern your use of the public Altaveyr marketing website.
Access to and use of the Altaveyr software platform, customer portals, subscription services, professional services, or other paid products may be governed by a separate Master Services Agreement, Software-as-a-Service Agreement, Order Form, Statement of Work, or other written agreement between Altaveyr and the applicable customer.
If there is a conflict between these Terms and a separate written agreement governing paid Altaveyr services, the separate written agreement will control with respect to those services.
2. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to use this Website.
If you use the Website on behalf of a company, organization, government entity, or other legal entity, you represent that you have the authority to act on behalf of that entity and to bind it where applicable.
3. Permitted Use of the Website
You may use the Website for lawful business and informational purposes, including to:
- Learn about Altaveyr products and services;
- Review platform capabilities and pricing information;
- Request product demonstrations;
- Contact Altaveyr;
- Apply for available programs, including the Altaveyr Founding Customer Program; and
- Access other resources made available by Altaveyr.
You agree to use the Website only in compliance with applicable laws, regulations, and these Terms.
4. Prohibited Activities
You may not:
- Use the Website for any unlawful, fraudulent, abusive, or malicious purpose;
- Attempt to gain unauthorized access to the Website, Altaveyr systems, customer environments, accounts, networks, or data;
- Probe, scan, test, exploit, or attempt to circumvent security or authentication measures without Altaveyr's express written authorization;
- Introduce malware, malicious code, automated attacks, denial-of-service activity, or other harmful technology;
- Scrape, harvest, or systematically collect information from the Website through unauthorized automated means;
- Copy, reproduce, distribute, modify, reverse engineer, or create derivative works from protected Website content except as permitted by law;
- Impersonate another person or entity;
- Submit false, misleading, fraudulent, or deceptive information through Website forms;

- Use Altaveyr trademarks, branding, content, or intellectual property without authorization.
Altaveyr may restrict or block access to the Website where we reasonably believe these Terms have been violated.
5. Information About Altaveyr Services
The Website provides general information about Altaveyr products, features, capabilities, pricing, frameworks, and services.
Website content is provided for informational and marketing purposes and does not constitute a binding commitment to provide any particular feature, functionality, service level, integration, security capability, compliance outcome, or product roadmap item unless expressly stated in a separate written agreement signed by Altaveyr.
Altaveyr may modify, add, remove, or discontinue Website content, product descriptions, features, pricing, or offerings at any time.
6. Cybersecurity, Compliance, and Professional Disclaimer
Altaveyr provides technology designed to help organizations manage cybersecurity governance, risk, compliance, business continuity, disaster recovery, and related activities.
Altaveyr does not provide legal advice, accounting advice, formal audit opinions, regulatory certifications, or guarantees of compliance.
Use of Altaveyr products or information does not by itself guarantee:
- Compliance with any law, regulation, standard, contractual requirement, or cybersecurity framework;
- Successful completion of an audit, assessment, certification, or regulatory review;
- Achievement or maintenance of any specific cybersecurity maturity level;
- Prevention of cybersecurity incidents, business disruptions, data breaches, or other losses; or
- Certification under frameworks or programs including CMMC, SOC 2, ISO 27001, NIST, PCI DSS, HIPAA, or any other standard.
Organizations remain responsible for evaluating their own legal, regulatory, contractual, cybersecurity, risk management, and compliance obligations and should obtain appropriate professional advice where necessary.
7. Demo Requests and Contact Forms
When you submit information through a Website form, you represent that the information you provide is accurate and that you are authorized to provide it.
Submitting a request for a demonstration, pricing information, or additional information does not create a customer relationship or obligate Altaveyr to provide products or services.
Altaveyr may contact you regarding your request, our products and services, and related business communications in accordance with applicable law and our Privacy Policy.
8. Founding Customer Program
Any Altaveyr Founding Customer Program described on the Website is subject to availability, eligibility, qualification, and acceptance by Altaveyr.
Submitting an application does not guarantee acceptance into the program.
Published Founding Customer Program pricing and benefits are informational until confirmed in an applicable written agreement or Order Form between Altaveyr and the customer.
Unless otherwise stated in a signed agreement, Altaveyr reserves the right to modify, close, extend, or discontinue a promotional or limited-availability program.
Any applicable subscription terms, implementation obligations, pricing commitments, renewal terms, and service conditions will be documented in the customer's applicable written agreement.
9. Intellectual Property
The Website and its content, including without limitation:
- Text;
- Graphics;
- Logos;
- Branding;
- Icons;
- Software;
- User interfaces;
- Designs;
- Visualizations;
- Documentation;
- Product names;
- Platform concepts; and
- Other materials
are owned by Altaveyr or its licensors and are protected by applicable intellectual property laws.
Altaveyr, the Altaveyr name, associated logos, product names, and related branding are trademarks or proprietary identifiers of Altaveyr.
Except as expressly permitted by these Terms or applicable law, no content from the Website may be copied, reproduced, modified, distributed, publicly displayed, commercially exploited, or used to create derivative works without prior written authorization from Altaveyr.
10. Feedback
If you voluntarily provide Altaveyr with ideas, recommendations, suggestions, feedback, or other input regarding our Website, products, or services ("Feedback"), you grant Altaveyr the right to use, develop, incorporate, reproduce, modify, and commercialize that Feedback without restriction or obligation to compensate you.
You represent that you have the right to provide any Feedback you submit.

Altaveyr does not control and is not responsible for third-party services, content, security, availability, or privacy practices.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE."
ALTAVEYR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
ALTAVEYR DOES NOT WARRANT THAT:
- THE WEBSITE WILL ALWAYS BE AVAILABLE OR ERROR-FREE;
- ALL INFORMATION WILL BE COMPLETE, CURRENT, OR ACCURATE;
- THE WEBSITE WILL BE FREE FROM VULNERABILITIES OR HARMFUL COMPONENTS; OR
- USE OF THE WEBSITE OR ALTAVEYR INFORMATION WILL PRODUCE ANY PARTICULAR BUSINESS, SECURITY, COMPLIANCE, OR REGULATORY RESULT.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALTAVEYR AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WEBSITE.
THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTAVEYR'S TOTAL LIABILITY ARISING FROM OR RELATING TO YOUR USE OF THE PUBLIC WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
This limitation applies only to claims arising from use of the public Website. Liability associated with paid Altaveyr products or services will be governed by the applicable customer agreement.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
17. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Altaveyr and its affiliates, owners, officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, and reasonable costs arising from:
- Your unlawful or unauthorized use of the Website;
- Your violation of these Terms;
- Your infringement of another party's rights; or
- Information or materials you submit through the Website in violation of applicable law or third-party rights.
18. Export Controls and Sanctions
You may not use the Website or Altaveyr services in violation of applicable United States export control, trade restriction, or economic sanctions laws.
You represent that you are not prohibited from receiving services under applicable United States law.
19. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
To the extent a dispute arising solely from use of the public Website is not governed by a separate written agreement, you agree that any legal proceeding relating to these Terms will be brought in an appropriate state or federal court located in Texas, and you consent to the jurisdiction of those courts.
Any separate agreement governing paid Altaveyr products or services may contain different dispute resolution or venue provisions, which will control for disputes governed by that agreement.
20. Changes to These Terms
Altaveyr may update these Terms periodically to reflect changes in our Website, business practices, products, services, or legal requirements.
When material changes are made, we will update the "Last Updated" date displayed at the top of this page.
Your continued use of the Website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
21. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
The invalid provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.
22. Waiver
Altaveyr's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
23. Assignment
You may not assign or transfer your rights or obligations under these Terms without Altaveyr's prior written consent.
Altaveyr may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, financing transaction, or other business transaction.
24. Entire Agreement
These Terms, together with the Altaveyr Privacy Policy, constitute the agreement between you and Altaveyr regarding use of the public Website.
Separate written agreements may apply to Altaveyr software subscriptions, professional services, customer accounts, and other paid services.
